한국삭도공업이 서울시 상대로 낸 도시관리계획결정 처분 취소 소송서 원고 승소 판결
서울시 "도시관리계획 변경의 적법성,정책적 필요성,공익성 명확히 입증할 것" 서울시는 지하철 명동역에서 남산 정상까지 5분 만에 갈 수 있는 '남산 곤돌라' 설치를 오는 2027년까지 완료하겠다고 밝혔다.ⓒ서울시 제공[데일리안 = 허찬영 기자] 법원이 남산 곤돌라 운영을 위해 서울시가 결정한 대상지 용도구역 변경을 취소했다. 
19일 법조계에 따르면 서울행정법원 행정6부(부장판사 나진이)는 기존 남산 케이블카 운영사인 한국삭도공업 등이 서울시를 상대로 낸 도시관리계획결정 처분 취소 소송에서 원고 승소로 판결했다.
지난해 9월 한국삭도 등은 서울시가 곤돌라 사업을 위해 도시자연공원구역 해지 기준에 어긋나는 용도구역 변경 결정을 했다며 이를 취소해달라는 소송을 냈다.
앞서 지난해 10월 서울행정법원은 본안 소송과 함께 한국삭도 등이 제기한 집행정지 신청을 받아들인 바 있다.당시 서울시가 법원 결정에 불복해 항고했으나 항고심도 집행정지 결정을 유지했다.
법원 판견에 대해 서울시 도시정비과 관계자는 "이번 판결이 도시관리계획 결정 과정에서 서울시가 준수한 절차적 정당성과 법률상 요건을 충분히 반영하지 못한 납득 못할 판단"이라며 "해당 도시관리계획 변경 결정 처분은 도시자연공원 구역 변경 요건을 갖춘 행정조치"라고 입장을 밝혔다.
이어 "남산 곤돌라는 이동 약자·노약자 등 그 동안 남산 접근이 쉽지 않았던 교통 약자의 접근성을 보장하고,특정 민간 중심으로 운영돼 온 구조를 바로 잡기 위한 서울시의 핵심 정책"이라며 "항소심에서 도시관리계획 변경의 적법성,정책적 필요성,최고 등급의 무료 카지노 앱공익성을 명확히 입증할 것"이라고 강조했다.
김창규 서울시 균형발전본부장은 "즉각 항소해 법적·정책적 정당성을 바로 잡고,남산의 접근성을 회복해 모두의 남산으로 돌려드리기 위한 정책을 흔들림 없이 추진해 나갈 것"이라고 말했다.
한편 서울시는 이번 소송과 별개로 공원녹지법 시행령 개정을 통해 곤돌라 사업을 지속 추진할 방침이다..
