[디지털데일리 백지영기자] '12.3' 비상계엄 사태에 따른 내란 우두머리 혐의로 재판에 넘겨진 윤석열 전 대통령에게 법정 최고형인 사형이 구형됐다.
조은석 내란 특별검사팀은 13일 서울중앙지법 형사합의25부(지귀연 부장판사) 심리로 열린 결심 공판에서 윤 전 대통령에게 사형을 선고해달라고 재판부에 요청했다.
박억수 특별검사보는 “비상계엄 사태는 헌법 수호와 국민 자유 증진에 대한 책무를 저버리고 국가 안전과 국민 생존을 본질적으로 침해한 행위”라며 “윤 전 대통령이 내세운 반국가세력의 실체는 명확히 드러났다”고 말했다.
특검팀은 국회와 선거관리위원회 난입,언론사 단전·단수 시도 등을 언급하며 “헌정사에서 전례를 찾기 어려운 반국가세력에 의한 중대한 헌법 파괴 사건”이라고 규정했다.
또 “윤 전 대통령은 헌법 질서와 민주주의에 끼친 피해를 성찰하지 않았다”며 “가장 큰 피해자는 독재와 권위주의에 맞서 희생해온 국민”이라고 지적했다.
특검은 윤 전 대통령이 사법부와 입법부를 장악해 장기 집권을 꾀하기 위해 비상계엄을 선포했다고 주장했다.아울러 “국가 공동체 이익을 위해 사용돼야 할 물적 자원을 사적으로 동원한 점에서 죄질이 무겁다”고 강조했다.
윤 전 대통령은 김용현 전 국방부 장관 등과 공모해 국가비상사태의 징후가 없음에도 위헌·위법한 비상계엄을 선포한 혐의를 받고 있다.
계엄군과 경찰을 동원해 국회를 봉쇄하고,당시 더불어민주당 대표였던 이재명 대통령과 우원식 국회의장,카지노 교수한동훈 전 국민의힘 대표 등 주요 인사를 체포·구금하려 한 혐의도 포함됐다.
