하지만 지난 8월 말 BIS는 이들 공장을 운영하는 중국 법인 3곳을 VEU 명단에서 제외하고 이달 31일부터 적용하기로 했다.예정대로라면 한국 기업의 중국 공장은 미국산 장비를 반입할 때마다 미국의 개별 허가를 받아야 해 운영에 큰 차질이 빚어지는 것이 불가피했다.
시행을 하루 앞두고 미국 정부가 규제를 완화함에 따라 한국 기업은 매년 필요한 장비 종류와 수량을 사전에 신청하고 미 정부 심사를 통해 수출을 승인받게 된다.VEU 명단 재포함에 비해서는 까다로운 절차지만 장비를 반입할 때마다 개별 승인을 받는 데 비하면 운영상 변수가 상당히 줄어드는 것으로 받아들여진다.미국 정부는 매년 장비 수출을 허용하더라도 중국 내 공장 확장이나 업그레이드를 위한 장비 반출을 불허한다는 방침은 유지하기로 한 것으로 전해졌다.
