특검 사건 34건 국수본 이첩… 檢에 영장 신청·송치 구조
검찰 전담 부서 無… "특검·검찰·국수본 논의도 없어" 조은석 특검이 15일 서울 서초구 서울고검에서 윤석열 전 대통령의 비상계엄 선포 동기와 최초 준비 시점 등을 포함한 수사 결과를 발표하고 있다. 
12·3 비상계엄 사태 관련 내란·외환 사건을 수사한 조은석 특별검사팀이 마무리 짓지 못한 사건은 검찰이 종결해야 하는 상황이 돼버렸다.230여명의 인원이 투입돼 6개월 동안 수사가 진행됐지만,결국 검찰의 손을 탈 수밖에 없게 됐다는 지적이 나오고 있다.
16일 법조계에 따르면 특검팀은 총 34건의 사건을 국가수사본부(국수본)로 이첩했는데,국수본이 사건을 종결하고 범죄 혐의가 있다고 판단할 때는 기소의견으로 송치해 검찰을 거쳐 공소제기가 이뤄져야 한다.
수사 과정에서도 검찰을 거칠 수밖에 없다.국수본이 수사하면서 강제수사를 할 경우 검찰에 압수수색 영장 등을 신청해야만 발부를 받을 수 있다.결국 검찰이 특검 사건의 모든 과정에 개입하게 된 셈이다.
문제는 검찰에 특검 사건을 전담할 조직이나 부서를 따로 두지 않아 사건이 넘어올 때마다 '배당 회의'를 거쳐 사건을 분배해야 하는 비효율적인 구조라는 것이다.특검팀이 해결하지 못한 사건을 이첩하기 전에 검찰과 논의하거나 양해를 구하지 못해 발생한 일이다.앞서 박근혜 정부 국정농단 사건은 특검 수사 종료된 이후 검찰이 특별수사본부를 구성해 남은 사건을 처리했다.
이번에는 특검팀에서 국수본으로 남은 사건을 넘겼고 사실상 서울중앙지검에서 각종 영장 청구,슬롯 무료 게임공소 제기,슬롯 무료 게임보완 수사 등을 맡게 됐는데 전담 부서가 정해지지 않은 상태다.
중앙지검 관계자는 "과거 경찰에 대한 수사 지휘가 있을 때는 유기적으로 협의를 했었다"며 "지금은 검찰이 사건에 대해서 경찰에 말할 수 있는 관계가 아니고,(중앙지검에) 관할이 있다면 그냥 해야 하는 상황"이라고 했다.
이어 "(내란특검이 이첩한 사건은) 검찰과 협의나 논의를 한 적이 전혀 없었다"며 "(중앙지검 내에서도) 논의가 진행되고 있지 않다"고 덧붙였다.
