22일 법조계에 따르면 의정부지검은 지난 20일 공직선거법 위반 혐의로 강 시장에게 벌금 90만원을 선고한 1심 판결에 대해 불복해 항소장을 제출했다.
검찰 관계자는 "검찰 항소 기준에 따라 항소했으며,사설 홀덤구체적인 사유는 밝힐 수 없다"고 말했다.
이어 지난 21일 강 시장 측에서도 항소장을 제출했다.
앞서 1심 재판부는 "양주시장이라는 자리는 공직선거법상 기부행위가 엄격히 제한된다는 점을 알거나 알 수 있는데도 간담회 형식을 빌려 상급기관인 경기도청 공무원에게 식사를 제공해 공직선거법을 위반했다"며 벌금 90만원을 선고했다.
선출직 공직자의 경우 공직선거법 위반으로 대법원에서 벌금 100만원 이상의 형이 확정되면 해당 직을 잃는데,사설 홀덤1심에서 90만원이 선고되면서 직위상실형은 피했다.
그러나 1심 판결에 대해 검찰과 강 시장 측 모두 항소해 2심 재판이 이어지게 됐다.
검찰은 이 사건과 관련해 앞서 벌금 200만원을 구형했다.
강 시장은 2022년 10월14일 오후 의정부시의 한 식당에서 경기도청 공무원 등 20명에게 133만원 상당의 식사를 제공한 혐의로 기소됐다.
당시 식사를 제공받은 이들은 양주시 출신 경기도 공무원들의 친목모임인 양우회 소속으로 알려졌다.
강 시장 측은 앞선 재판에서 "식사를 제공한 간담회는 양주시의 공리 증진을 위해 상급기관인 경기도청 공무원과 도의회 관계자 등을 대상으로 양주시청 현안과 업무 시책 협조의 공감대를 도출해 내기 위한 것"이라며 혐의를 부인한 바 있다.
