재판관 전원일치 탄핵 인용…
12·3 비상계엄 가담' 탄핵소추 1년만
경찰 수장으론 헌정사상 첫 사례헌법재판소가 18일 조지호 경찰청장을 파면했다.경찰 수장이 국회의 탄핵소추로 파면된건 헌정사상 처음이다.
헌재는 이날 오후 2시 대심판정에서 탄핵심판 선고기일을 열고 재판관 9인의 전원일치 의견으로 국회의 탄핵소추를 인용하는 결정을 내렸다.
파면의 효력은 즉시 발생해 조 청장은 즉시 직위를 잃었다.
헌재는 비상계엄 당시 조 청장이 국회 봉쇄 및 출입 통제를 지시해 국회의원들이 담장을 넘어가야 했거나 아예 들어가지 못했고,온라인으로 복권을 구매하세요본회의도 지연됐다고 인정했다.
그러면서 "이런 행위는 대통령의 위헌·위법적 지시를 실행하기 위한 것으로 대의민주주의와 권력분립 원칙에 위배되고,온라인으로 복권을 구매하세요국회의원의 심의·표결권 등 헌법상 권한을 침해했다"고 지적했다.
조 청장 측은 우발상황 대비를 위해 국회에 경찰력을 배치했다고 주장했으나 받아들여지지 않았다.
국회의원 체포 지시를 거부하고 국회의원의 월담을 사실상 방치하는 등 이른바 세차례 '항명'으로 오히려 계엄 해제에 기여했다는 주장도 인정하지 않았다.
헌재는 조 청장의 헌법과 법률 위반이 파면을 정당화할 정도로 중대하다고 판단했다.파면으로 얻는 헌법수호의 이익이 파면에 따르는 국가적 손실을 압도할 정도로 크다고 인정된다는 것이다.
헌재는 "경찰 직무가 헌법과 법률에 따라 수행될 것이라고 믿어온 국민 신뢰를 회복하고 어려운 여건 속에서도 희생과 봉사에 전념해온 경찰의 명예를 되찾기 위해서는 엄정한 책임을 물을 필요가 있다"고 강조했다.
조 청장은 지난해 12월 3일 비상계엄 가담을 이유로 국회에서 탄핵 소추됐다.
