쿠팡이 개인정보 유출 피해자 전원에게 5만원 상당의 보상 쿠폰을 지급하겠다고 밝힌 가운데 법조계에서 해당 쿠폰을 사용해선 안 된다는 경고가 나왔다.
쿠팡을 상대로 손해배상 청구 소송을 진행중인 법무법인 일로는 29일 집단소송 참여자들이 모인 카페에 이 같은 내용의 경고문을 올렸다.
일로는 “이번 보상안은 직접적인 피해 복구를 위한 현금성 배상이 아닌 쿠팡 상품 구매 시 일부 금액을 할인해 주는 방식”이라며 “이는 쿠팡이 자산을 출연하기보다 고객의 추가 소비를 유도해 비용 부담을 최소화하려는 책임 회피성 조치”라고 말했다.
이어 “5만원 쿠폰은 4개의 카테고리로 나뉘어 있어,블랙잭 인슈런스전체 혜택을 받으려면 최소 4회 이상의 개별 구매가 강제되어 과도한 소비를 유도하고 있다”고 덧붙였다.
일로는 “가장 주의해야 할 점은 쿠폰 사용 시’해당 보상으로 모든 배상이 완료된 것으로 간주하며,블랙잭 인슈런스향후 모든 민형사상 이의를 제기하지 않는다’는‘부재소 합의 조항’이 약관에 포함됐을 가능성”이라고 말했다.부재소 합의는 분쟁 당사자 간에 원만히 타협했으므로 이후 민형사상 이의를 일절 제기하지 않겠다는 뜻을 담은 법률 용어다.쿠폰을 사용하고 나면 추후 손해배상 소송에 참여할 때 제약을 받을 수 있다는 뜻이다.
일로는 “쿠팡은‘쿠폰 자동 적용’시스템이 존재해 이용자의 의사와 상관없이 쿠폰이 사용돼 권리가 제한되거나 추후 손해배상액이 감축될 우려가 있다”면서 “쿠팡에서 제공하는 보상 쿠폰을 사용했다가 본인이 모르는 불이익이 발생할 수 있으므로 쿠폰 사용을 자제해달라”라고 말했다.
앞서 쿠팡은 “개인정보 유출 사고에 대한 책임을 통감하고 고객 신뢰를 복원하려 한다”며 개인정보 유출 통지를 받은 3370만개 계정의 고객 전원에게 1인당 5만원 상당의 쿠폰을 지급한다고 밝혔다..
