오 시장과 강철원 전 서울시 정무부시장의 변호인은 23일 서울중앙지법 형사합의22부(조형우 부장판사)의 정치자금법 위반 혐의 사건 첫 공판준비기일에서 “피고인들은 명태균에게 여론조사를 맡긴 적이 없고 사업가 김한정에게 비용 지급을 요청한 적도 없다”고 말했다.
그러면서도 “다만 선거를 돕겠다면서 여론조사 전문가를 자처한 명태균에게 강 전 부시장이 시험용 여론조사를 시켜봤는데,FIBA chl결과물이 도저히 신뢰할 수 없어 관계를 단절했다”고 주장했다.
오 시장 측은 또 “정치적으로 이용될까 우려된다”며 재판을 내년 6월 지방선거 이후로 미뤄달라는 취지로 요청했다.
이에 재판부는 “검토는 해보겠지만 지방선거 이후 진행하는 문제는 약간 소극적”이라며 “(특검법이) 가능하면 6개월 안에 끝내라고 돼 있는데,FIBA chl(지방선거일인) 6월 3일 이후 시작하면 어렵지 않을까”라고 답했다.김건희특검법상 1심 선고는 공소제기일로부터 6개월 이내 이뤄져야 하므로 이달 1일 민중기 특별검사팀에 기소된 오 시장 1심 판결은 내년 6월 전까지는 나와야 한다.
아울러 오 시장 측은 공소 제기된 내용이 당내 경선 과정에서 벌어진 일이라‘2021년 재·보궐 선거 등에서 선거 개입 의혹 사건’을 수사 대상으로 정한 김건희 특검 수사 대상에 해당하지 않는다는 취지로도 주장했다.
이와 함께 오 시장과 강 전 부시장이 공모했다는 일시나 장소 등과 관련해서도 공소사실이 특정되지 않았다고 문제를 제기했다.이에 특검 측은 추가 의견서를 내기로 했다.
한편 공판준비기일은 정식 재판에 앞서 양측 입장을 확인하고 증거조사 계획을 세우는 절차다.피고인 출석 의무는 없어 오 시장은 이날 법정에 출석하지 않았다.
