공수처법상 고발 대상에 파견 검사 포함된 점 고려 김건희 특검팀 민중기 특검 ⓒ연합뉴스 
경찰이 편파수사 의혹으로 고발된 김건희 특검팀(민중기 특별검사) 사건을 고위공직자범죄수사처(공수처)에 이첩했다.
17일 경찰청 국가수사본부 특별전담수사팀은 "전날(16일) 민 특검 및 김건희 특검팀 소속 성명불상 검사 등에 대해 제기된 직무유기 혐의 고발 사건을 공수처에 이첩했다"고 밝혔다.
경찰은 사건을 이첩한 이유에 대해 고발장에 파견 검사가 포함된 점을 고려했다고 밝혔다.공수처법 25조2항에 따르면,슬롯 해커공수처 외 다른 수사기관이 검사의 범죄 혐의를 발견한 경우 사건을 공수처에 반드시 이첩하도록 규정하고 있다.다만 이첩을 받아들일지는 공수처의 유권해석에 달려있다.
특검팀은 지난 8월 윤영호 전 통일교 세계본부장으로부터 통일교 교단이 정치인들에게 금품을 공여하는 것을 목격하거나 전해 들었다는 진술을 확보했다.
하지만 특검팀은 이러한 진술이 특검법상 수사 대상에 포함되지 않는다며 별 다른 수사를 하지 않았고,경찰에 사건을 넘겼다.이러한 과정에서 '편파 수사' 의혹이 제기됐다.
조배숙 국민의힘 사법정의수호 및 독재저지 특별위원회 위원장은 등은 지난 11일 민 특검이 더불어민주당 소속 의원들에 대한 금품수수 혐의를 발견했음에도 이를 제대로 수사하지 않았다며 서울경찰청에 고발장을 제출한 바 있다.
동시에 전재수 전 해양수산부 장관을 비롯해 민주당 소속 전∙현직 의원들을 정치자금법 위반 및 뇌물수수 혐의로 고발했다.
특검팀은 논란이 일자 이달 들어 사건번호를 부여하고 관련 수사 기록을 경찰에 이첩했다.
