"사법부 화답에 법안 발의 필요성 감소"조국혁신당은 18일 대법원이 '국가 중요사건 전담재판부 설치예규' 제정과 관련해 '환영' 입장을 내놨다.혁신당은 사법부가 내란전담재판부 설치를 준비함에 따라 내란전담재판부법의 발의 필요성도 낮아졌다고 의미를 부여 했다.
박병언 혁신당 대변인은 이날 논평을 통해 "대법원은 오늘,룰렛 따는법내란·외환죄와 반란죄(군형법)에 대하여 국가적 중요성과 신속한 처리 필요성을 고려해 이들 사건만 전담해 집중 심리하는 전담재판부를 설치하는 대법원예규를 제정한다고 밝혔다"며 "혁신당은 이를 매우 환영한다"고 평가했다.다만 "뒤늦게 발표한 것이 아쉽다"고 덧붙였다. 조국 조국혁신당 비상대책위원장이 15일 국회에서 열린 비상대책위원회의에서 발언하고 있다.2025.9.15 김현민 기자 
박 대변인은 "혁신당은 국회가 마련한 내란전담특별재판부 설치법안이 윤석열의 변호인단에게 재판지연의 기회를 줄 것을 우려한 바 있다"며 "사법부가 대법원 예규제정을 통해 국민적 의혹을 해소해 줄 것을 요청한 바 있었다"고 소개했다.이어 "대법원이 국회의 그간 노력에 화답하여 현재 서울중앙지방법원 13개 합의부에서 진행중인 내란재판에 대하여 그 항소심을 진행할 서울고등법원에 집중심리재판부를 지정하도록 결정했다"고 소개했다.
박 대변인은 더불어민주당이 내란전담재판부법과 관련해 위헌 논란이 제기된 부분을 손보기로 한 부분도 거론하며 "국회는 국회대로,룰렛 따는법사법부는 사법부대로 내란청산을 위해 협력하는 것이 당연하다"고 했다.이어 "권력분립은 잘못을 견제하라는 것이지,룰렛 따는법국력을 모아야 할 중점과제에는 협력관계에 있어야 할 것"이라고 밝혔다.
이어 "사법부의 화답에 의해 사실상 내란전담재판부가 도입된 만큼,국회에서도 법률을 통한 내란전담재판부 구성을 촉구하는 법안 발의의 필요성도 상당히 낮아졌다고 할 수 있다"고 했다.아울러 지난 5일 전국 법원장이 윤석열 전 대통령의 비상계엄을 위헌으로 선언한 점도 거론하며 "대법원이 하급심에 대하여 내란재판이 기본적으로 유죄취지로 판결돼야 함을 선언한 것도 사법부로서 진일보한 태도 변화라고 할 것"이라고 평가했다.
