미국에서 수입 원자재로 태양광 모듈을 생산하는 한화큐셀이 트럼프 행정부를 상대로 관세 반환 소송을 제기했다가 취하했습니다. 
한화큐셀은 최근 한화큐셀의 미국 법인이 미 세관국경보국(CBP)을 상대로 트럼프 대통령이 국가비상경제권한법(IEEPA)에 근거해 부과한 상호 관세를 무효로 해달라며 제기했던 소송을 취하했다고 오늘(22일) 밝혔습니다.
한화큐셀 관계자는 “해당 소송은 미국 법인이 고용한 로펌 측이 회사 측과 상의 없이 실수로 진행한 것”이었다며 “소송이 제기된 것을 확인한 뒤 소를 취하했다”고 설명했습니다.
트럼프 대통령이 IEEPA에 근거해 부과한 각종 관세는 앞서 1,pci 슬롯 확장 카드2심 법원에서 위법하다고 판결했으며 현재 연방대법원에서 심리하고 있습니다.
대법관 다수가 지난 11월 5일 구두변론에서 관세의 적법성을 주장하는 행정부의 논리에 의구심을 드러낸 이후 관세 위법 결정을 할 가능성이 크다는 관측이 제기됐습니다.
관세 반환 소송은 미국 대형 유통업체 코스트코가 지난달 먼저 제기해 주목받았습니다.
코스트코가 소송을 제기한 논리는 한화큐셀과 동일한데 USCIT는 코스트코가 회복 불가능한 피해를 입증하지 못했다는 이유로 지난 15일 가처분 신청을 기각했습니다.
USCIT는 대법원에서 관세를 위법하다고 판단해 관세 재정산을 명령할 경우 이에 반대하지 않겠다는 입장을 트럼프 행정부가 밝혔기 때문에 이 소송을 제기하지 않더라도 원고가 관세를 환급받을 수 있다고 설명했습니다.
