중학교 재직 중 제자 2명을 수 차례에 걸쳐 성추행한 교사가 항소심에서도 징역형의 집행유예를 선고받았다.

서울고법 인천원외재판부 형사2부(임영우 부장판사)는 10일 항소심 선고 공판에서 아동·청소년의 성보호에 관한 법률상 강제추행 혐의로 구속 기소된 교사 A씨에게 징역 1년에 집행유예 2년을 선고한 원심판결을 파기하고 징역 2년에 집행유예 3년을 선고했다.

재판부는 또 A씨에게 성폭력 치료 강의 40시간을 이수하고,불법사이트아동·청소년이나 장애인 관련 기관에 5년 동안 취업하지 못하도록 제한했다.

항소심 재판부는 "범행 방법과 피해자들과의 관계에 비춰 죄책이 가볍지 않다"면서도 "피고인이 반성 중이고 형사처벌 전력이 없는 점,피해자 1명과 합의했고 다른 피해자에게 형사 공탁한 점을 고려했다"고 양형 이유를 밝혔다.

A씨는 지난해 11월부터 올해 4월까지 경기도 모 중학교에서 학생 2명을 각각 3차례에 걸쳐 성추행한 혐의로 기소됐다.

A씨는 피해자들을 뒤에서 껴안거나 허리를 만지는 등 강제로 추행한 것으로 조사됐다.

교육 당국은 최초 피해 사실을 인지하고 전수 조사를 벌여 추가 피해를 확인한 뒤 A씨를 직위 해제했다.
