한 대형건설사가 공사비를 올려달라며 착공을 미뤘다가,100억 원대 배상금을 물어줄 위기에 놓였습니다.그동안 대형 건설사들이 우월적 지위를 이용해서 무리한 공사비를 요구하는 경우가 많았는데,법원이 이 행태에 제동을 건 걸로 보입니다.

이유경 기자가 취재했습니다.

[리포트]
낡은 주상복합을 허물고 아파트와 오피스텔 430가구를 짓는 대구의 한 사업지.

주민 이주는 2년전에 끝났지만,흉물처럼 방치돼 있습니다.

"이주는 벌써 좀 됐죠.1년,벌써 2년 가까이.한창 공사비가 올랐잖아요.(공사가) 계속 안되고 밀리고 있는 거죠."

사업이 이렇게 지연된 것은 공사비 갈등때문입니다.

지난 2020년 한국토지신탁은 이 사업을 추진하면서 현대건설과 공사비 1205억원에 시공 계약을 맺었습니다.

그런데 2년뒤 현대건설이 공사비 488억원을 더 달라고 요구하면서 문제가 불거졌습니다.

토지신탁측은 계약서대로 물가상승률을 반영해 8% 인상을 제시했지만,현대건설은 우크라이나 전쟁 등으로 자재비 등이 급등했다며 40% 인상을 요구했습니다.

결국 토지신탁은 현대건설을 상대로 133억원의 손해 배상 소송을 제기했고,루비 슬롯 프로모션1심 법원은 토지신탁의 손을 들어줬습니다.

"현대건설이 정당한 이유없이 공사 착공을 지연했다"며 토지신탁이 청구한 배상액 전액을 주라고 판결한 겁니다.

현대건설은 옛 둔촌주공 등 서울 주요 사업지에서도 공사비 갈등 때문에 사업을 중단한 적이 있습니다.

정비업계 관계자
"계약이 된 다음에는 대기업들은 이미 계약서에 본인들이 유리한 내용들이 많이 들어가 있어요.그렇기 때문에 시행사,발주처는 끌려다닙니다."

대형 건설사가 공사비를 일방적으로 올리는 관행에 법원이 제동을 걸었다는 평가가 나옵니다.
